These terms and conditions set out the basis on which Tree Surgeons Temple provides arboricultural and related tree care services to domestic and commercial clients. By making a booking, accepting a quotation, or allowing work to proceed, the client confirms that they have read, understood, and agreed to these terms. They are intended to provide a clear framework for the relationship between the client and the service provider, covering the scope of work, booking process, payments, cancellations, liability, waste handling, and other important matters. For the avoidance of doubt, these terms apply to all services supplied by tree surgeons in Temple, unless otherwise agreed in writing.
The word “client” means the individual, business, landlord, managing agent, or other party requesting the service. The word “services” includes tree surgery, pruning, crown work, stump removal, hedge work, site clearance, and any associated arboricultural tasks agreed in advance. Any variation to these terms must be expressly agreed in writing by an authorised representative of Tree Surgeons Temple. If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply in full force and effect.
These terms are designed to be practical and fair, while also reflecting the responsibilities that come with working on living trees, using specialist equipment, and managing green waste in line with relevant UK requirements. Because each site is different, some details may need to be adapted to the circumstances of the job. However, the principles below remain the same unless a separate written agreement states otherwise. Where a quotation or estimate differs from these terms, the written quotation will take precedence only in relation to the specific point of difference.
Booking Process
The booking process for Tree Surgeons Temple normally begins with an enquiry and a description of the required work. The client should provide accurate information about the trees, access, nearby structures, known defects, and any constraints that may affect the job. This may include previous work, utility lines, protected status, boundary considerations, or signs of disease. Based on the information supplied, a quotation or estimate may be issued. In some cases, a site visit may be required before pricing or scheduling can be confirmed.
A booking is not confirmed until Tree Surgeons Temple has accepted the order and, where requested, any deposit or advance payment has been received. The company may decline a booking where access is unsafe, where the requested work is outside its capabilities, where statutory consent appears to be required, or where weather conditions or workload make performance impractical. The client is responsible for ensuring that the person instructing the work has authority to do so. If a third party such as a tenant or managing agent makes the booking, they must ensure they have the correct permissions.

This includes providing safe access, removing obstacles where possible, and ensuring that any relevant permissions are in place. If the work cannot proceed because the client has not provided correct information or adequate access, the company may charge for the wasted attendance, rebooking, or any additional time incurred. Where tree surgery services are scheduled for a specific day, reasonable flexibility may be required due to weather, equipment issues, emergency call-outs, or other factors beyond reasonable control.
Payments
Unless agreed otherwise in writing, payment is due in full on completion of the services. Tree Surgeons Temple may request a deposit for larger, scheduled, or specialist works, particularly where materials, equipment hire, or labour commitments must be secured in advance. Any deposit requested will be stated on the quotation or booking confirmation. Deposits are generally used to reserve time and resources and may be non-refundable where the client cancels without sufficient notice, subject to applicable consumer law.
Accepted payment methods will be communicated at the time of booking or invoicing. If payment is not received by the stated due date, the company may charge reasonable recovery costs and interest to the extent permitted by law. No title to any materials supplied, such as timber products or other items expressly agreed to remain the property of the company until paid for, shall pass until full payment has been made. In the event of part-payment, Tree Surgeons Temple reserves the right to apply the payment first to outstanding fees, then to any interest or charges, unless otherwise required by law.
Where the scope of work changes on site because of hidden defects, unsafe conditions, additional waste, or client-requested alterations, the price may need to be revised. Any material change will normally be discussed with the client before additional work proceeds. Quotations are based on the information available at the time and may be valid only for the period stated. After that period, the company may amend the price to reflect changes in labour, waste disposal, fuel, equipment, or supply costs.
Cancellations and Rescheduling
The client may cancel or reschedule a booking by giving reasonable notice. Where the cancellation is made sufficiently in advance and no costs have been incurred, no cancellation fee may apply. However, if the company has already allocated labour, arranged equipment, hired machinery, obtained permits, or incurred disposal charges, those costs may be charged to the client. The closer the cancellation is to the scheduled date, the more likely it is that some or all of the agreed fee may be payable.
Tree Surgeons Temple may also need to cancel or postpone work due to severe weather, unsafe site conditions, equipment failure, staff illness, emergencies, or circumstances outside its control. In such cases, the company will aim to rearrange the work for a suitable date. The company will not be liable for loss arising from a necessary postponement, provided the delay is reasonable and caused by events beyond its control. If the client insists on proceeding despite conditions that create a risk to people, property, or equipment, the company may refuse to continue the work.
If a booking is cancelled after the team has arrived on site, or if access is unavailable when work is due to begin, the client may be charged for attendance, preparatory labour, and any unavoidable costs already incurred. This applies equally where the client fails to obtain required permissions, does not secure the area, or gives instructions that make the work impossible to complete safely. Rescheduling is always subject to availability and may be treated as a new booking if the original circumstances have materially changed.
Liability
Tree Surgeons Temple will exercise reasonable skill and care in delivering the services. However, tree work involves inherent risks, especially where trees are diseased, unstable, storm-damaged, or situated near buildings, roads, fences, underground services, or other vulnerable features. The company is not responsible for defects or hazards that could not reasonably have been identified before work began, nor for losses arising from inaccurate information supplied by the client. Any advice given is based on the visible condition of the tree at the time and the facts made available.
The client must take reasonable steps to protect valuables, vehicles, ornaments, garden furniture, and other items that may be affected by the work. While precautions will be taken, the company will not accept liability for minor cosmetic disturbance to lawns, borders, driveways, or adjacent surfaces where such disturbance is a normal and unavoidable consequence of tree surgery. The company is not liable for indirect or consequential losses, including loss of profit, loss of enjoyment, or delay to third-party works, except where such liability cannot lawfully be excluded.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under UK law. Where the company is found liable for a direct loss, that liability will be limited to the amount paid or payable for the specific work giving rise to the claim, except where a different limit is required by statute. The client is encouraged to notify the company promptly of any concern so that issues may be investigated and, where appropriate, remedied.
Waste Regulations and Site Clearance
All green waste, arisings, woodchip, timber, brushwood, and similar material generated during the service will be handled in accordance with applicable UK waste regulations. Tree Surgeons Temple will remove, transport, store, or dispose of waste only through lawful and responsible methods. Where waste is taken away by the company, it may be reused, recycled, composted, processed into woodchip, or disposed of at an authorised facility, depending on the type of material and the arrangements agreed with the client.
Unless expressly stated otherwise, the quotation will specify whether waste removal is included. If waste is to remain on site, it will normally be left in a location reasonably agreed with the client, provided this does not create a safety issue or obstruction. The client is responsible for any subsequent storage, movement, or disposal of waste left on site, unless the company has agreed to manage that part of the service. Waste transfer may require documentation, and the company may retain records in line with legal and operational requirements.
Where diseased material, invasive species, or contaminated debris is present, special handling may be necessary. The client must inform the company in advance of any known contamination, tree pests, protected habitats, or unusual disposal restrictions. If waste is discovered on site that requires separate treatment or disposal beyond what was reasonably anticipated, additional charges may apply. The client must not request or permit the company to dispose of waste unlawfully, including fly-tipping, burning where prohibited, or leaving material in a manner contrary to environmental law.
Access, Safety, and Customer Responsibilities
The client must ensure that the working area is reasonably accessible and that the company can operate safely. This may include arranging parking where possible, keeping children and pets away from the work zone, and advising neighbours or affected occupants when needed. The client must also disclose any underground services, overhead hazards, hidden structures, or restrictions that may affect the work. If a permit, licence, or consent is required, responsibility for obtaining it should be clearly agreed in advance, but the client remains responsible for ensuring that the necessary authority exists.
Tree Surgeons Temple may suspend or stop work if it believes continuing would present an unacceptable risk. This may include situations where weather changes unexpectedly, the tree behaves unpredictably, or the site becomes unsafe due to third-party interference. If the client or another person interferes with the work, gives unsafe instructions, or attempts to override safety procedures, the company may withdraw from the site and charge for time spent and costs incurred. The client agrees to follow reasonable safety instructions given by the team during the performance of the services.
Any photographs, measurements, or notes taken during the course of the work may be used for operational, insurance, training, or record-keeping purposes. These records may also assist in demonstrating the condition of the tree or site before and after the work. Personal data, if collected, will be handled in line with applicable data protection requirements. However, these terms do not set out a separate privacy policy, and any such policy, if provided, should be read alongside them.
Complaints, Variation, and Entire Agreement
If the client has concerns about the services, they should raise them as soon as reasonably possible after completion. Tree Surgeons Temple will review genuine issues in good faith and may, where appropriate, inspect the work or offer a remedy. The company will not normally consider complaints made long after the event where the condition of the tree, site, or waste has changed and fair assessment is no longer possible. Any informal discussion does not amount to a waiver of rights unless confirmed in writing.
No employee, contractor, or representative of Tree Surgeons Temple has authority to vary these terms unless the variation is confirmed in writing by an authorised person. If the company agrees to any special arrangement for a particular job, that arrangement will apply only to that specific booking and will not alter the general terms for future work. These terms, together with the quotation or written booking confirmation, form the entire agreement between the parties in relation to the services and supersede prior discussions or representations to the extent permitted by law.
The company may update these terms from time to time to reflect changes in law, business practice, or service arrangements. The version in force at the time of booking will normally apply to that booking, unless a later change is required by law. Continued use of the services after updated terms have been issued may be treated as acceptance of the revised version for future bookings. Clients are therefore encouraged to review the applicable terms each time they instruct tree surgery services.
Governing Law
These terms and any dispute or claim arising out of or in connection with them, including non-contractual disputes or claims, are governed by the laws of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction, except where mandatory consumer protection rules provide otherwise. Nothing in these terms is intended to limit any statutory rights that apply to the client as a consumer or business customer under UK law.
General Provisions
If the company chooses not to enforce any right or remedy immediately, that does not mean it has waived that right or remedy. A delay or partial exercise of any right does not prevent later enforcement. Headings are included for convenience only and do not affect interpretation. References to the singular include the plural and vice versa where the context allows. Any notice required under these terms may be given in writing by a method reasonably suitable to the circumstances, provided it can be evidenced.
The parties acknowledge that tree surgery is an inherently variable service and that reasonable judgement must often be exercised on site. Accordingly, these terms aim to balance operational flexibility with clear expectations regarding price, timing, safety, waste, and responsibility. By proceeding with a booking, the client agrees to cooperate in good faith and to allow the work to be carried out in a safe, lawful, and professional manner.
